The investor-State panorama remains one that is
complex. While global macroeconomic
factors continue to give rise to growth in investor-State arbitrations, many
States are taking steps to reduce their exposure to investment treaty disputes
by withdrawing from investment treaties, or concluding treaties with no or
limited investor-State dispute mechanisms. At the same time, legislative reform and
judicial decisions around the world reflect a general willingness to enforce
international arbitration awards - except when the awards concern
intra-European ("EU") disputes, where the approach of courts varies
significantly.
