A number of major developments have occurred recently in the construction industry which, it is hoped, will improve the level of disputes and how they are dealt with. Adjudication, as a first attempt to resolve a dispute, is now a statutory right under the Housing Grants, Construction and Regeneration Act 1996, and the new Arbitration Act 1996 has introduced substantial improvements to arbitration. The Joint Contracts Tribunal is introducing new adjudication and arbitration procedures for all the main building contracts and this book will consider these against the background of the new legislation and relevant case law.
