Product liability has been a problem for U.S. manufacturers and others in commerce since the mid-1970s. The adoption of the Directive requiring Member States of the EEC to make legal provisions for product liability in 1988 introduces strict product liability in the EEC and brings an increased risk of claims on producers. Its main theme is that product liability should be seen as a challenge to man- agement. Product liability has particular implications for the marketing function and it also introduces legal and insurance considerations.
