Kerr on Receivers and Administrators: 1st Supplement to the 17th Edition

This supplement brings the main text up to date to cover the Criminal Justice Act 1988 and the case law that has interpreted the Insolvency Act 1986. The case law clarifies the effect and extent of new procedures and defines some of the principles applicable to the operations of the administrator. New cases discudded include: Bristol airport plc vs Powdrill (1990), CA, which discussed the extent to which Parliament's objectives can be taken into account in ensuring that the administrator has the power to carry out those objectives; Re Land and Property Trust plc (1991), on parallel winding up and administration petitions; Re a Debtor (No 222 of 1990) on the grounds on which a petitioner can be held personally responsible for the breach of his statutory duties.
