Description
A perceptible dynamic of the contemporary evolution of law consists in the increasingly repeated use of algorithmic techniques to sort, prioritize, understand, elaborate, propose, decide, apply and judge. Such an evolution affects the legislator, the judge, the administration and, more broadly, every citizen, whose daily life is increasingly governed by the norm derived from the algorithm. The present work thus endeavours to analyse the way in which algorithms are changing the law, its logic, its development and its application. It attempts to identify the implications of these uses, on the constitutional requirement of equality before the law for example, and draws up certain avenues of development capable of responding to these issues, which will certainly become more topical in the coming years.
