A Right to Energy

The subject of this collected volume is the right to energy. The legal nature of a right to energy worldwide is explored through the interpretation of constitutional provisions, as well as other laws. The right to energy is not a human right explicitly recognized by the international legal order.

Although energy is a commodity of vital importance to human beings, it has not yet been recognised at the international level, nor has it been given a specific legal form and content.
Nevertheless, various national legal orders, at the constitutional or legislative level, have taken measures to ensure access to energy. These examples are elaborated upon in this collection, in order to allow for a holistic approach to the concept of the right to energy.

Currently in the international scientific community, the debate on energy is conducted largely based on approaches concerning energy justice, and the transition to green energy. These approaches, although interesting and valid, do not produce legally binding outcomes, and as a result, do not bind states when adopting energy and social policies. This book adds the constitutional dimension of a right to energy, coupling a moral and political issue with the law, and formulating it in such a way that it can be pursued judicially.

The book will appeal to students of constitutional and energy law, judges, researchers, and policy-makers.
